How long does a mutual consent divorce take in Kerala?

Under the Hindu Marriage Act and the Special Marriage Act, spouses who have lived separately for at least one year can file a joint petition before the Family Court. The court usually takes up the second motion after six months, and the Supreme Court has held that this waiting period can be waived in suitable cases. For Christian marriages under the Divorce Act, 1869, the separation period is two years. Actual timelines depend on the Family Court and the facts of each case.

Who can claim maintenance, and under which law?

A wife, children and parents who are unable to maintain themselves can claim maintenance under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 125 of the Code of Criminal Procedure). Interim maintenance can also be sought in matrimonial proceedings, and monetary relief is available under the Protection of Women from Domestic Violence Act, 2005.

What relief is available in a domestic violence case?

Under the Protection of Women from Domestic Violence Act, 2005, an application can be filed before the Magistrate seeking protection orders, residence orders, monetary relief, custody orders and compensation.

What is the time limit to file a cheque bounce case?

Under Section 138 of the Negotiable Instruments Act, a demand notice must be sent within 30 days of receiving the bank's dishonour memo. If the drawer does not pay within 15 days of receiving the notice, the complaint must be filed within one month after those 15 days expire. Missing these deadlines can defeat the case, so act promptly.

Is there a deadline for filing a motor accident (MACT) claim?

Under the amended Motor Vehicles Act, a compensation claim should be filed before the Motor Accident Claims Tribunal within six months of the accident. The claim can be filed where the accident occurred, where the claimant lives or carries on business, or where the defendant resides.

Where and when should I file a consumer complaint?

Under the Consumer Protection Act, 2019, a complaint must be filed within two years of the cause of action. Claims up to Rs. 50 lakh go to the District Consumer Commission, claims from Rs. 50 lakh to Rs. 2 crore to the State Commission, and higher claims to the National Commission. Complaints can also be filed online through the e-Daakhil portal.

What should I do if a criminal case is registered against me?

Consult an advocate as early as possible. Depending on the case, options may include applying for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 438 CrPC), regular bail, or approaching the High Court. Avoid giving statements without legal advice.
